Terms of Use
1. Terms and Principles
"Service" — software, website and related services provided to you; "User" — an individual or legal entity using the Service; "Content" — any data, materials and information placed or transmitted using the Service.
2. Acceptance of Terms
The fact of registration, authorization or actual use of the Service means your full and unconditional agreement with the terms of the Agreement. If you do not agree with the terms, you are obliged to stop using the Service.
3. Changes to the Agreement
We may unilaterally change the Agreement by publishing an updated version. Continued use of the Service after publication of changes means your agreement with them.
4. Service Description, Development Status and Absence of Guarantees
The Service is in an active development stage. Consequently, discrepancies between the description of functionality and its actual operation are possible, as well as the occurrence of technical errors. The Service is provided "as is" and "as available". The functionality, scope, and composition of the Service may change, be supplemented, or reduced without prior notice. We do not guarantee uninterrupted operation of the Service, data safety, or the Service's compliance with specific User expectations and goals.
5. Registration, Account and Security
- You undertake to provide accurate and up-to-date information during registration.
- You are responsible for the safety of your login and password and for all actions performed under your account.
- You undertake to immediately notify us of any unauthorized access to the account.
6. User Requirements
- By using the Service, you confirm that you have legal capacity and compliance with applicable legislation requirements (including age restrictions).
- If you act on behalf of an organization, you confirm that you are authorized to accept the Agreement on its behalf.
7. Paid Services and Pricing
At the time of publication, paid services are not provided. The Service is available for use without charge.
- In the future, we may introduce paid features. In this case, the conditions, cost and payment procedure will be published separately, and this Agreement will be updated.
- Certain usage restrictions (for example, resource limits or functional restrictions) may apply to accounts and are determined by the Service's internal policies.
8. User Content and Rights
- You retain rights to your Content. By providing Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to store, process, technically copy and display it within the scope necessary for the Service to function.
- You warrant that you have all necessary rights to the Content posted and that it does not violate the rights of third parties and applicable legislation.
- We have the right to remove or block Content that violates the Agreement or law.
9. Prohibited Activities
- Violation of legislation, rights of third parties, norms of morality and ethics.
- Distribution of malicious software, interference with the Service's operation, attempts to bypass technical restrictions.
- Unauthorized access, password cracking, vulnerability scanning, DDoS attacks.
- Collection, processing and storage of third parties' personal data without legal grounds.
- Any actions that may cause damage to us, users or third parties.
10. Privacy and Personal Data
We respect your privacy and process personal data in accordance with applicable legislation and our privacy policy. By using the Service, you agree to data processing in the specified volume and purposes.
- The Service may use cookies, local storage (localStorage/sessionStorage) and similar technologies to ensure session operation, interface settings, security and (if available) aggregated analytics.
- You can configure cookie management in your browser settings; however, this may limit the Service's functionality.
11. Data Storage and Backup
- We do not undertake to store your Content and data for any period unless otherwise expressly stated.
- You are fully responsible for independent backup of your data.
- We are not responsible for loss, damage or inability to access data for any reason, including but not limited to hardware failures, software, human errors, third party actions, force majeure.
12. Service Availability and Maintenance
- We do not provide availability guarantees, service levels (SLA) or recovery times.
- The Service may be temporarily unavailable due to technical work, updates, infrastructure disruptions or other reasons.
- We are not responsible for losses caused by Service unavailability, delays, errors or failures.
13. Security
We apply reasonable measures to protect the Service, however, we do not guarantee absolute security. You understand the risks associated with data transmission over communication networks and accept them.
14. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, punitive or consequential damages, including lost profits, data loss, loss of business reputation, business interruption caused by the use or inability to use the Service, even if we were notified of the possibility of such damage.
- We are not responsible for: loss, damage or loss of access to data; Service unavailability; errors, delays and failures; third party actions; force majeure.
- Aggregate liability, if any, is limited to the minimum size permitted by applicable legislation; in the absence of payments from the user, monetary compensation is not provided.
15. Disclaimer of Warranties
The Service is provided "as is" and "as available". We expressly disclaim all express and implied warranties, including warranties of fitness for a particular purpose, merchantability, error-free operation and continuous availability.
16. Indemnification
You agree to indemnify us, defend and hold us, our affiliates, officers, employees and partners harmless from any claims, demands, losses, expenses and costs (including reasonable attorneys' fees) arising from your breach of the Agreement, law or third party rights or your use of the Service.
17. Force Majeure
We are released from liability for full or partial non-performance of obligations caused by force majeure circumstances: natural disasters, wars, strikes, accidents, infrastructure failures, government actions, terrorist acts, power and communication network outages and other events beyond reasonable control.
18. Termination of Use and Blocking
- We may suspend or terminate your access to the Service in case of Agreement violation or on other grounds provided by law.
- You may stop using the Service at any time; however, previously effective Agreement provisions that are permanent in nature continue to apply.
19. Intellectual Property
All exclusive rights to the Service and its elements (design, software code, databases, trademarks, etc.) belong to us or lawful right holders. Copying, modification, decompilation, distribution and other use not provided for by the Agreement or law is not permitted.
Any ideas, suggestions, and feedback provided by you regarding the improvement of the Service may be used by us free of charge and without any obligations to you.
20. Third Party Services and Links
The Service may contain links to third party resources. We do not control and are not responsible for the content, policies and practices of third party resources and services.
21. Export Control and Sanctions
You undertake to comply with applicable export control rules, sanction regimes and restrictions, and not to use the Service in prohibited jurisdictions or for prohibited purposes.
22. Assignment of Rights
We have the right to transfer (assign) rights and transfer obligations under the Agreement to third parties. You do not have the right to transfer your rights and obligations without our prior consent, unless otherwise provided by law.
23. Dispute Resolution and Applicable Law
The Agreement is governed by the law of the relevant jurisdiction at the place of registration of the Service operator, unless otherwise provided by imperative norms. Disputes are subject to resolution in the competent court at the location of the operator, unless otherwise established by law.
24. Communication and Notifications
Official notifications may be sent by means of publication in the Service, email or other available methods. You agree to receive such notifications electronically.
25. Other Terms
- If any provision is found invalid, this does not affect the validity of the remaining provisions.
- Our non-enforcement of any provision does not mean waiver of rights in the future.
- This Agreement constitutes the complete agreement between you and us regarding the use of the Service and replaces all previous agreements.
